Local Authority (LA) Maintained and Academy Special Schools
LA and Academy Special schools are for children and young people who have an Education, Health and Care Plan (EHCP) and whose needs cannot be met in a mainstream school, even with extra support.
Maintained special schools are owned and maintained by the local authority.
Academy special schools are publicly funded. These schools have more freedom and control over:
- the curriculum
- school hours and term dates
- staff pay and conditions

Independent Special Schools
Independent Special Schools are usually privately run for profit. The Department for Education keeps a list of approved schools, including post‑16 settings. They are approved under Section 41 of the Children and Families Act, which means the government officially recognises them.
Section 41 schools provide specialist education for children with special educational needs (SEN). They offer tailored support for a range of disabilities and learning needs. A school can only be added to the approved list if its owner agrees.
